Millwork Scanner - Terms of Use

1. Introduction

Welcome to Millwork Scanner! These Terms of Use ("Terms") govern your use of the Millwork Scanner application ("App"), provided by Hillcrest Cabinets ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Millwork Scanner is a mobile application that provides users with tools for scanning and managing millwork projects. The App offers various features, including the ability to subscribe to the "Export to Mozaik" feature for enhanced project management capabilities.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you have the legal capacity to enter into these Terms.

4. Subscription Terms

4.1 Subscription Description: The "Export to Mozaik" feature is available through a monthly auto-renewing subscription. The subscription allows you to export project data to the Mozaik format.

4.2 Subscription Pricing: The subscription is priced at $19.99 USD per month.

4.3 Payment: Payment will be charged to your Apple ID account at the confirmation of purchase.

4.4 Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.5 Managing Subscriptions: You can manage your subscription and auto-renewal settings by going to your Apple ID account settings after purchase.

4.6 Cancellation: You may cancel your subscription at any time, but no refunds will be provided for any unused portion of the subscription term.

5. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found at Privacy Policy URL. By using the App, you agree to the terms of the Privacy Policy.

6. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, subject to these Terms.

7. Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose.

• Modify, adapt, or hack the App.

• Use the App in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the App.

8. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, Hillcrest Cabinets shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App.

• Any unauthorized access to or use of our servers and/or any personal information stored therein.

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the App will meet your requirements, be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy, completeness, or reliability of any information obtained through the App.

11. Disclaimer of Responsibility for Errors and Data Loss

Hillcrest Cabinets is not responsible for any errors or inaccuracies in the data provided by the App. We are not liable for any loss of data, whether resulting from delays, non-deliveries, misdeliveries, or service interruptions caused by any third party, by our negligence, or by your errors and/or omissions.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
